Welcome to Epitec, Inc. (“Epitec”), website www.epitec.com (https://epitec.com) (the “Site”). This page (“Notice”), privacy policy (“Privacy Policy”) applies to Epitec’s services including the services provided in this website www.epitec.com, as well as any other website, owned or operated by or for Epitec. It outlines the terms and conditions of the Site “www.epitec.com,”  “Epitec,” “we,” “us,” and “our” refer to Epitec, Inc., and its divisions, subsidiaries, and affiliates. This privacy policy (“Privacy Policy”) describes how we may use and disclose personally identifiable information that we may collect about you through this Site or our recruitment process (“Personal Information”). Please review this Notice carefully. By visiting, accessing, browsing, or using the Site (“Use”), all users and viewers (“You,” “you,” “User,” or “user”) acknowledge acceptance of the terms and conditions outlined in this Notice. If you do not accept the terms and conditions in this Notice, please do not use the Site. Epitec and its subsidiaries reserve the right to update this Notice from time to time in its sole discretion. You should review this Notice periodically for updates and changes. 

Epitec understands that the privacy of your Personal Information is important to you. The nature of our business requires us to collect and maintain Personal Information. This Policy describes the types of Personal Information we collect, how we may use that information, and how we protect it. We also provide information on how you can update your information or contact us with questions about our privacy practices. By visiting or using any Epitec Sites, you consent to the collection of Personal Information, personal data, and other information/data (“information”), as well as the uses described in this Privacy Policy. 

Information We Collect 

Users can access certain features of the Epitec Sites without disclosing information. Users may be required to submit information to apply for a job, and to register to access certain content/portions of the Epitec Sites. When you register with the Sites, create a Epitec account, and/or apply for a job, we may ask for certain Personal Information and identifiers such as: your name, mailing address, phone number, email address, geographic location, age or age range, Social security number and other demographic (“personal”) information/date; information related to your current and past employment, such as the industries in which you have worked, and your current and past job titles; your work experience and compensation; your skills and abilities, including language proficiencies; your education, including degrees held and institutions attended; your preferences regarding the type of employment or job placement you are seeking; your anticipated availability to begin work; the names and contact information for those you refer as references; and any login ID and password created by you. 

You also may elect to upload a resume or curriculum vitae, which will provide any Personal Information you have chosen to disclose to us by including it in the file you upload. If you decide to contact us directly or through an internet application, we will receive the contact information you provided so that we could respond and any other Personal Information you chose to include in your message. 

You may elect not to provide us with all of the information we request. However, if you do not provide the information we have requested, we will not be able to provide you with an account or be able to use our internet applications that facilitate job placement. 

We may combine information we collect about you with other information we receive from additional sources, such as information you may have provided to us by other means or information collected by our job placement consultants. 

Information concerning the computer hardware and software you are using when you visit the Epitec Sites may be collected automatically. This information may include: the IP address, browser type, domain names, access times, and referring website addresses. Epitec uses this information primarily to maintain the quality of its service and to provide general statistics about website visitors. Epitec may store and process information in the United States of America or any other country in which Epitec or its affiliates, subsidiaries, or agents—domestic or foreign—maintain facilities. By using the Epitec Sites, you consent to any such transfer of information outside of the country where you reside, where you are a citizen, and/or where you access the Epitec Site(s). 

When you visit our Sites, we may send one or more “cookies” to your computer or other device. A “cookie” is a small data file transferred by a website to your computer’s hard drive. Epitec uses cookies to help improve the Site and to personalize your visit by customizing our web pages. Epitec may also collect information about your computer, including your IP address, operating system, and browser type. Most browsers will accept cookies automatically from the Site. You may refuse to accept cookies by adjusting your preferences on your browser. It should be noted that by doing so, you may be unable to access certain pages or areas of the Site. 

Epitec’s website pages may contain electronic images known as web beacons, also referred to as a single-pixel gifs, or pixel tracker URL, that permit Epitec to count the number of users who have visited those pages and allow collection of other website statistic, such as the popularity of certain content, verification of system and server integrity, etc. Web beacons are not intended to give Epitec access to your Personal Information, but instead to compile aggregated statistical data concerning the use of the Epitec Sites. Web beacons collect limited types of information which may include a cookie number, the time and date of a page view, and a description of the page on which the web beacon resides. 

 

We have collected the following categories of personal information from within the last twelve (12) months:

Personal information does not include: 

  • Publicly available information from government records. 
  • Deidentified or aggregated user information. 
  • Information excluded from the CCPA’s scope, like certain health or medical information and other categories of information protected by different laws. 

 

We obtain the categories of personal information listed above from the following categories of sources: 

  • Directly from you. For example, from forms, verbal questions and answers, or online submissions that you have completed and provided to us. 
  • Indirectly from you. For example, through information we collect from our clients, vendors, or third parties. 
  • Directly and indirectly from activity on our websites and applications. For example, from submissions through our website portal or website usage details collected automatically. 

 

How We Use Your Information 

Epitec uses your information to provide you with job placement services. We also may use your information for a variety of related purposes and other business functions, such as: 

  • To establish and maintain an employment or staffing/placement relationship with you; 
  • To fulfill your requests for information and to communicate with you, such as alerting you to available positions or services we offer;
  • To provide you with services, such as job placement, training, career counseling, or career transition services; 
  • To arrange employment or temporary assignments for you; 
  • To provide payroll and human resources functions, including employee benefits programs and to otherwise comply with human resource requirements; To assess whether you are qualified for a position or task; 
  • To consider and address feedback you may provide to us; 
  • To provide referral services, such as if you refer a friend or colleague to us, or if we refer you to a client; 
  • To inform our clients, candidates, and business partners about our services; 
  • For the performance of our placement, management, or other services agreements with our clients, including billing and enforcing payment arrangements; 
  • To help us administer or improve our business and our services, the applications and other processes we use to deliver those services, and the promotional materials we have developed to describe those services; 
  • To perform certain research and analyses; 
  • To protect the integrity of or to improve our websites, information systems, and security; 
  • To prevent physical harm or financial loss; and 
  • For certain administrative purposes, such as risk management, to fulfill legal obligations or address compliance needs, and to resolve or defend legal claims. 

Information We Share 

  • We may share the Personal Information we collect about you with other parties. For example, we may share information about you with our clients in order to identify appropriate job opportunities for you.  
  • With our divisions, subsidiaries, and affiliates; 
  • With clients who may have job opportunities available or interest in placing our candidates; 
  • With business partners, such as job placement consultants; 
  • With service providers, who are only authorized to use information to perform services on our behalf or for limited administrative purposes, such as complying with legal requirements; 
  • Epitec also reserves the right to disclose information, without notice, when reasonably requested or required by law enforcement authorities or other government officials; 
  • When Epitec believes that it is necessary to: (i) protect the integrity of the Site; (ii) protect rights of Epitec; (iii) comply with any court order; (iv) comply with any legal proceedings; (v) assert Epitec claim under the Terms of Use; and (vi) satisfy any claims regarding violations of third party’s rights; 
  • When we believe disclosure is appropriate to prevent physical harm or financial loss; 
  • When reasonably necessary to an investigation of suspected or actual illegal activity; 
  • As needed to protect the vital interests of an individual; and 
  • In the event we sell or transfer all or a portion of our business or assets. 

 

We maintain administrative, physical, and technical safeguards intended to protect against the loss, misuse, or unauthorized access, acquisition, alteration, or destruction of information we collect through physical and automated means. Your Epitec account is protected by your log-in credentials, which you must keep secure and confidential. Unfortunately, however, no security system, or system of transmitting Personal Information over the internet, can be guaranteed to be 100% secure. 

We communicate our privacy and security guidelines and standards to Epitec employees and enforce these requirements within the company. 

We also require that our suppliers protect your Personal Information collected against loss, misuse, or unauthorized access, acquisition, alteration, or destruction. 

 

Your Rights and Choices 

The CCPA provides (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights. 

Access to Specific Information and Data Portability Rights 

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable request, we will disclose to you: 

  • The categories of personal information we collected about you. 
  • The categories of sources for the personal information we collected about you. 
  • Our business or commercial purpose for collecting or selling that personal information. 
  • The categories of third parties with whom we share that personal information. 
  • The specific pieces of personal information we collected about you (also called a data portability request). 
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: 
  • Sales, identifying the personal information categories that each category of recipient purchased; and 
  • Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained. 

 

Deletion Request Rights 

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception or good faith, commercially reasonable business justification applies. 

We may deny your deletion request if retaining the information is necessary for us or our service providers to: 

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you. 
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities. 
  3. Debug products to identify and repair errors that impair existing intended functionality. 
  4. Exercise free speech, ensure the right of another entity to exercise their free speech rights, or exercise another right provided for by law. 
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.). 
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent. 
  7. Enable solely internal uses that are reasonably aligned with data subject expectations based on your relationship with us. 
  8. Comply with a present or potential legal obligation. 
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it. 

 

Non-Discrimination 

Epitec will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: 

  • Deny you goods or services. 
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties. 
  • Provide you a different level or quality of goods or services. 
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 

  

Accessing and Correcting Your Information 

Epitec endeavors to maintain accurate information and provides you with options to update your information. You can contact portal@epitec.com and modify your information at any time. 

Links to Other Sites 

The Site may contain links to other websites maintained by third parties and not owned or operated by Epitec (“Other Sites”). Links to the Other Sites are provided merely for your convenience. Epitec does not control the Other Sites or their privacy practices, which may differ from Epitec practices. Epitec is not responsible for the privacy practices or the content of the Other Sites. Epitec is not responsible for any losses, damages, or other liabilities incurred as the result of the use of any of the Other Sites. You are solely responsible for your access of the Other Sites. 

Limitation of Liability and Limited Guarantee 

The Epitec Sites may contain errors or problems and are provided “as is.” Epitec disclaims all warranties, expressed or implied, in connection with the Epitec Sites, including implied warranties of merchantability. If an Epitec, Inc. Site fails to perform in accordance with the representation made by Epitec through its corporate office, Epitec will use commercially reasonable efforts to correct the failure. It is expressly agreed that your exclusive remedy, and Epitec’s aggregate liability, whether in contract, tort, or otherwise, in connection with Epitec Sites shall not exceed one hundred dollars ($100.00). Epitec shall in no event be responsible for any incidental, consequential, or punitive damages in connection with the Epitec Sites (including, but not limited to, lost profits, business interruption, loss of business information, or other pecuniary loss) regardless of whether such liability is based on a breach of contract, tort (including negligence), strict liability, breach or warranties, failure of essential purpose, or otherwise, and even if Epitec has been advised of possibility of such damages. 

Updates to Our Privacy Policy 

We reserve the right to modify or update this Privacy Policy without prior notice to you to reflect changes in our information collection, use, and security practices. If the Policy is updated, we will post a new effective date to let you know when the Policy was most recently updated. Please check this page for any changes to our Privacy Policy.
